The CDM Regulations make it clear that no-one shall accept an appointment or be appointed, if they are not competent to understand and manage their legal duties.

Client duties:

Can you assess competence?

Can you sign the HSE Notification to confirm that you understand your legal duties?

Designer duties:

Do you understand all your legal duties?

Do you know how to become competent and be able to demonstrate it?

Design Risk Management:

Do you know what 'ALARP' means and how to go about it?

Contractor duties:

Do you know what's involved to plan, manage and monitor?
